Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody

A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in federal custody.

In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal proceedings center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now comply with the terms of his release from custody in Tennessee. This decision shifts his supervision to the jurisdiction handling his criminal case.
